Bank charge reclaim frequently asked questions

Q. How long does it take to reclaim bank charges?

A. It depends very much on the on the bank, building society or credit card company involved however, ordinarily it shouldn't take much longer than 3 months to complete a claim and receive a refund.

Q. How much does it cost?

A. Because we work on a no-win, no-fee basis Reclaim One don't ask for any payment up front. Once the claim has been successful and the charges and interest refunded, we will deduct our fee from the settlement received.

Q. Is it possible to claim from an account that's been closed?

A. As long as the charges date back no further than 6 years.

Q. Why can't I reclaim the charges myself?

A. You are perfectly within your rights to do so, however, our service is here to remove all of the the worry and hassle out of the process, which can be quite lengthy and, in some cases, confusing or even intimidating. There are some banks, building societies and credit card companies that will try and make the process as slow and as complicated as possible in order put individual claimants off.

At Reclaim One we aim to provide you with a fully managed professional service to maximise your refund as swiftly and as efficiently as possible.

Q. Won't I have to go to Court?

A. We've yet to witness to a bank actually taking a case all the way to a hearing as, if they were to lose their case, it could be a big risk for them. In the very unlikely event that a claim might be heard in court, we would represent you.

Q What happens if the bank try to contact me regarding my claim?

A. As you will have instructed us to act on your behalf, they should have no recourse to contact you directly on the matter. If they do telephone you then simply refer them to us. Should they write to you, just forward the letter on to us and we will deal with it for you.

Q. What if the bank closes my account?

A. In theory they could close your account or cancel your credit card - we've never seen this happen. The British Bankers Association has issued guidance to the banks requesting them not to do this. If your bank did do this it would probably be seen as a ‘retaliatory action' and we would raise a complaint on your behalf with the regulator - this would not look good for the bank in question.

Q. Is there a limit to how much I can claim?

A. There is no specific limit, although we would advise that you keep the claim below £5,000 as this would keep the claim in the realm of The Small Claims Court where no costs can be awarded. If you have a larger claim then we
will split it into smaller, more manageable claims for you.

Q. Could this action have an affect my credit rating?

A. In a word, no. The process is entirely legal and will have no effect on your current or future credit rating.

Q. Is Reclaim One regulated?

A. Since 23rd April 2007 all claims companies are required to be registered under the Claims Management Regulation (The Compensation Act 2006) via the department of constitutional affairs. Reclaim One is regulated by the Ministry of Justice in respect of regulated claims managment activities - Authorisation number CRM5438.
